Very Knowledgeable Patient & Prompt

Unhappy ex-client

I do not recommend Jason P. Bailey. I paid him $2500 to do a limited scope representation on a custody case that was being appealed. I needed help to get the first portion of the bifurcated case onto the record. No help there. Bailey could not figure out how to get the dependency portion onto the re...cord, which is/was a big deal. Instead, he focused on meeting deadlines, which I was handling, and was very little help with legal substance, which is what I needed. He latched onto the initial lack of notice, citing Ala.R.Civ.P.4, declaring that the ruling was void due to lack of notice. After that declaration he stopped analyzing the case, until I discovered Ala.R.Juv.P.13(A)(3) allows dependency proceedings to continue without proper service. This indicated to me Bailey had very little knowledge of juvenile law (as he had claimed) and just wanted my $$. Although he had the complete record, he could not analyze it to detect several legal errors: (1) hearsay evidence was admitted at the adjudication trial (reversible error), (2) no adjudication on first removal order of whether the removal in child's "best interest", (violation of 12-15-312(a)(1), (3) no adjudication of the reasonableness of DHR's efforts to prevent removal or reunify the family (violation of 12-15-312(a)(2) and case law, F.V.O. v. Coffee County DHR), (4) no search by DHR for viable alternatives (violation of due process under 14th amendment), (5) federal law repeatedly violated during the adjudication trial (42 CFR Part 2 was violated by two attorneys, DHR caseworker and judge). I asked for a refund of half my retainer after firing him from his complete focus on Ala.R.Civ.P.4, which doesn't apply to dependency proceedings. Bailey refused to refund me for the hours he charged that ended up being worthless to the case. Do not hire him for any legal matter that is important to you.
