Mr. Chotiner received his Juris Doctor degree,cum laude, from the University of Miami School of Law, where he was on the Dean's List and worked on the Entertainment and Sports Law Review. He received his Bachelor of Arts in political science, with honors, from the University of Florida. At the University of Florida Mr. Chotiner was a member of the Golden Key National Honor Society and the Sigma Alpha Mu social fraternity.
Mr. Chotiner is admitted to practice before all state courts in Florida, as well as the United States Court of Appeals for the Eleventh Circuit and the United States District Courts for the Southern, Middle and Northern Districts of Florida. Mr. Chotiner also represents clients in arbitration proceedings and he has served as an arbitrator.
As a Board Certified labor and employment law specialist, Mr. Chotiner's practice includes all areas of labor and employment law litigation, including discrimination, harassment and retaliation claims based on race, gender, age, disability, national origin, religion and ethnicity. He also represents clients in Family and Medical Leave Act claims, whistle-blower claims, workers' compensation retaliation claims and claims involving employment contracts and non-compete agreements. In addition, Mr. Chotiner has extensive experience litigating claims for unpaid overtime compensation and minimum wages under the Fair Labor Standards Act, including collective actions. His labor and employment law practice also includes preventative labor relations and counseling employers on their policies and practices, including training for management and rank-and-file employees. Mr. Chotiner has had a labor and employment law article published by the Florida Bar Journal and he has been featured as a lecturer at labor and employment law seminars.
Mr. Chotiner’s practice also includes the defense of claims brought under Title III of the Americans with Disabilities Act. These matters generally involve disabled individuals suing businesses and other places of public accommodation, claiming that barriers exist which allegedly prevent them from fully enjoying the products and services being offered. Many such claims allege “physical barriers,” such as inaccessible restrooms and parking lots, but over the past few years the scope of the claims has expanded to allegations that a business’ website is inaccessible or otherwise non-compliant. In addition, Mr. Chotiner’s practice includes issues arising under the Fair Housing Act and similar state and local laws.
Mr. Chotiner also has experience in other areas of commercial and complex litigation, including breach of contract, commercial disputes, insurance litigation, landlord and tenant issues, and real estate and business torts. He is also experienced in probate, trust and fiduciary litigation.
Mr. Chotiner resides in Boca Raton with his wife, a Palm Beach County schoolteacher, and his two children.
