While I appreciated you acknowledging that I did the job successfully for you, your “edited” review from three years ago admits that your case was dismissed. John, while we understand your frustration we are, however, unsure why you directed that frustration at our office? Because you are absolutely correct, your vehicle is worth at least $22,000 (you and I looked it up together, it isn't my personal opinion) and thus if you filed a Chapter 7, the trustee (not us) would demand you turn the vehicle over or make him a fair market value to keep it. Vehicle exemptions in bankruptcy are a function of state law and have nothing do with us as the attorney or the trustee for that matter. So yes we are in fact on your side by counseling you that a Chapter 7 is not in your best interest at this time. We are trying to protect your assets. You are also correct that we didn't discuss our fees for a Chapter 13 because you entirely dismissed the idea due to the monthly cost and you simply don't have the minimum income to support a confirmable chapter 13 plan. As for the previous attorney who took your case for free I would certainly try to use him again or you can call our office and we can give you the number to the local legal aid office.
