The Best Choice

My case was particularly difficult and with sever consequences. Finding a lawyer was a difficult prospect as I live abroad. I contacted Roger prior to an arrest warrant being issued and he was able to put together an argument that convinced the detective to drop the case. Roger saved my life! I find ...it difficult to express just how much this means to me. If it had not been for Roger and his tireless efforts, my life would have been torn upside-down. To say that I recommend Roger to be your attorney would be an understatement. Rest assured that, if you decide to hire Roger, you will have correctly made one of the most important decisions of your life!

Exceptional

Roger Foley was a beacon of hope to me at a time when my options appeared limited and the likelihood of a satisfactory resolution seemed high on impossible. Not only was he able to defend me, his calm and empathetic demeanor offered emotional succor to myself and those who care about me as I do them.... Roger Foley took a chance on me, he was very forth coming with me and I found him to be experienced, responsive, knowledgable especially trustworthy and the list goes on, I kept having the look of sadness & defeat and he would say to me (Why the sad face every time u come into my office, I would say because I’m scared and he would say to me, ohhh come on now with a grin cheer up don’t let it defeat you and to always keep a positive attitude for myself, my daughter and those around me) and he would remind me every chance he gets by picking up the phone just to check in and by meeting, although I got the outcome I wanted that alone gave me hope even if I didn’t get the out come because he never steer me wrong, and he never gave up on me. I’m so Internally grateful for everything he has done for me. Extremely rude, ignorant about VOP's, and all about the mighty dollar.

I was arrested for a VOP in April 2013 and was release on my OR. My status hearing was in September 2013. I consulted over the phone with several attorneys and decided upon Mr. Foley. His retainer for my VOP was for $2,500. After my initial phone consultation, we never spoke again until stat...us hearing at which he showed up unprepared 1.5 hours late. This enraged the Judge and the prosecutors. Upon his late arrival, he quickly reviewed my file. The Prosecutor threatened prison time and stated they were gong to add an additional VOP. My VOP's were for non-payment of court ordered payments and not informing my Probation Officer immediately upon obtaining employment (I told her 2 months late). I was re-arrested at that status hearing. A new hearing was set 7 days later and he was verbally warned by the Judge to not be late. At the second hearing, he was 45 mins late AGAIN! He quickly approached me and stated he needed a $15,000 retainer instead of the $2,500 right now in cash. I told him that I could not afford that so he approached the bench and withdrew himself from the case so they put me back in jail since I had no attorney. This is for a VOP mind you, not an initial arrest and case. Why the $15,000 was demanded I am unsure. Only depositions were required from my probation officers to get their facts and evidence. i believe that his main issue was that I had a top Prosecutor against me and he did not want to go up against him. His character, both ethically and personally, are extremely lacking and were amplified by his lack of respect for the court in his non-compliance of mandated court appearance as well as his lack of concern for my circumstances arising from his tardiness and ignorance of my case. Mr. Foley never returned my retainer, even though he never handled one motion, filing, or argument. His tardiness (twice) cost me my freedom in the beginning and more money as I was left to retain another competent attorney who knew how to handle a VOP (which resulted in being false after her depositions were conducted).

I can not confirm or deny that this person was a client. Florida Bar ethics rules and the rule of confidentiality limit my response. If the alleged client would like to waive that privilege and sign a written waiver, then I could speak to whether they were a client, what charges if any were against them, what the issues were before the court and how they were handled. A Waiver of confidentiality would also allow me to point to specific public records, notes, transcripts, etc taken during the alleged courtroom issues. It is difficult not being able to discuss an incident or incidents that allegedly occurred when confidentiality and ethics rules prevent me from even acknowledging whether this person was or was not a client. Without crossing any legal boundaries, please consider some of the points made by the person writing this review. "The Prosecutor threatened prison time and stated they were gong to add an additional VOP" and "I had a top Prosecutor against me and he did not want to go up against him." "he showed up unprepared 1.5 hours late." "This enraged the Judge and the prosecutors. " " At the second hearing, he was 45 mins late AGAIN! " All courtrooms in Florida are audio recorded or have a court reporter present. Claims like these could cause the judge to hold an attorney in contempt, require a "rule to show cause" hearing, cause the Florida bar to reprimand, suspend, or revoke a license of an attorney. Unethical

My name is Lt Col Pete, retired, Air Force Academy Graduate and 5 time combat deployer. My son was arrested for trespassing a construction site at night with no malicious behavior, drugs or alcohol. I was away on a trip and my wife picked my son up from 'Juvy' where she had signed a waiver of spe...edy trial for 'diversion' to the youth court since he was a minor. My wife, shook up, sought a free consultation from Mr. Foley who charged my wife '$1575 based on the possible diversion outside of juvenile court'. Despite Mr. Foley reading the 'waiver of speedy trial' my wife signed for the special diversionary program to youth court; Mr Foley made a fee agreement for something she had already done. Mr. Foley could do nothing for my son but took his money anyway and when I questioned his ethics he indicated to me I had paid him for his time. What time? There was nothing he could do. I took care of my son's case on the phone myself contacting the court and officers in charge of his consequences who guided me through the process. Mr. Foley allegedly made phone calls for his $1575. I will be filing a complaint with the Florida Bar for Attorney Discipline. Anyone wishing to validate the veracity of my complaint may check with the Florida Bar. I lived by an honor code serving my country and Mr. Foley's conduct is unbecoming of ethical lawyer standards. He took advantage of 2 Mom's emotions and lack of knowledge for the legal system. I offered to pay him his hourly rate for the phone calls he legitimately made and/or to apply his fee toward expungement of my son's trespass accusation. Mr. Foley wouldn't hear it and hung up the phone on me. I recommend you get another lawyer. Please read the reviews carefully and look for detail over fluff. Check the bar and critically think before hiring this unethical lawyer. Is $1575 worth risking your reputation or explanation to the Florida Bar? If he intended to do the right thing would he hang up the phone on me?

In accordance with Forida Bar rules, without a waiver of confidentiality from an alleged client. I can not respond based on confidentiality. I do my best to respond to reviews, however I need the person writing a negative review to sign a waiver of confidentiality. Upon receipt of said waiver, I would respond quickly and accurately to any negative allegation. If a waiver of confidentiality is not received then I can not respond nor defend myself.
