Kai Li Fouts is the Managing Partner in the law firm of Eisenberg & Fouts, P.A. located in downtown West Palm Beach, Florida. Ms. Fouts practices exclusively in the area of criminal defense in both state and federal courts and has an Martindale AV Peer Review Rating. Ms. Fouts graduated from the University of Wisconsin-Madison in 1991 with a Bachelor of Arts Degree with a double major in Communication Arts, Radio-Television-Film and Political Science. She, thereafter, attended law school in New York at Syracuse University, College of Law, graduating with a Juris Doctor in 1995.   

During the summer after her second year of law school, Ms. Fouts worked with William J. Sheppard, Esquire, in Jacksonville, Florida, one of the most prestigious criminal, civil rights attorneys in Florida. After graduation from law school, Ms. Fouts began the practice of law with the Office of the Public Defender in Palm Beach County. While there, Ms. Fouts was not only fortunate to have tried cases in both the felony and misdemeanor trial division, but she also wrote several appeals before the Fourth District Court of Appeal while in the appellate division. In 1999, Ms. Fouts was the first associate to practice with James L. Eisenberg, P.A. In 2003, Ms. Fouts was named partner and the firm became what is now known as Eisenberg & Fouts, P.A., and she continues to practice in the areas of criminal trial and appellate work.  

Since entering the practice of law, Ms. Fouts served on the Board of Directors of the Palm Beach Association of Criminal Defense Lawyers and was honored to represent that organization as a member of the Palm Beach County Criminal Justice Commission. She was elected and served as President of the Palm Beach Association of Criminal Defense Lawyers for the 2015-2016 year. She has previously served on the Board of the Craig S. Barnard, American Inn of Court LIV as Secretary and as Director of Membership and continues today as an Emeritus Member. Ms. Fouts also served as a Florida Bar appointed attorney member of the Fifteenth Circuit Unlicensed Practice of Law Committee. Since 2010, Ms. Fouts has served as a volunteer advocate for the Palm Beach County Commission on Ethics. In February, 2011, Ms. Fouts was appointed by Chief United States District Judge Frederico A. Moreno as an attorney member of the Federal Magistrate Judge Merit Retention Panel, and in April, 2011, as an attorney member of the Federal Magistrate Judge Merit Selection Panel. In May, 2012, Ms. Fouts was recognized by the Legal Aid Society of Palm Beach County, Inc., The Florida Supreme Court and the Florida Pro Bono Coordinators Association and received a special commendation for her pro bono work in the year of 2011, and  in 2013, she was honored to receive the "And Justice For All Award". Ms. Fouts served as the Chair of the Florida Bar's 15th Circuit (15A) Unlicensed Practice of Law Committee through 2016. In 2015, Ms. Fouts was a Co-Chair of the Criminal Law Section for the Palm Beach County Bar Asosciation’s Bench Bar Conference and the following year she was asked to be a Co-Chair for the entire Palm Beach County Bar Association's Bench Bar Conference. Ms. Fouts served from 2017 thru 2020 as a committee member for The Florida Bar’s Fifteenth Circuit’s Grievance Committee ”F.” In 2017, Ms. Fouts started working with the Palm Beach County Criminal Justice Commission’s Core Workgroup for the MacArthur Foundation’s Grant to reduce the jail population and racial and ethnic disparities in Palm Beach County and currently continues to serve as a voting committee member.  

Other community involvement includes her commitment to the Hanley Foundation’s efforts to raise money to fund education and prevention of substance abuse in Florida’s public and private schools. She has served as a committee member, a Co-Chair, and an Honorary Chair for their Annual Family Picnic.  She is honored to serve as Vice President and Board Member for the Young Singers of the Palm Beaches, which teaches children through music the importance of breaking down social barriers, developing life skills, providing outlets for creativity, and fostering good citizenship.  Additionally, she is a dedicated Board Member of Dance Theater of Florida, an organization committed to providing access to dance and the performing arts for the underserved.  

In 2017, Ms. Fouts became the sole owner and Managing Partner of Eisenberg & Fouts, P.A., upon the retirement of her beloved career-long law partner, James L. Eisenberg.  Mr. Eisenberg remains Of Counsel to the firm, and is a cherished friend and mentor.  In February, 2019, Christopher R. Jette and Jason L. Naparstek joined Eisenberg & Fouts, P.A., and have expanded the practice to include representation in the Marital and Family Law area.   

Ms. Fouts is happily married and has three amazing performing arts children.  She actively practices the Korean Martial Art of Tae Kwon Do, is an avid Wisconsin Badger Fan, and lives in Palm Beach County.

Best attorney i have ever had the pleasure of using.
Out of all the attorneys I have ever hired, she was by far the best one i worked with. I have never seen one that was so on top of their game, knew every detail about the case and so precise in her delivery. Dont let her slender frame and friendly demeanor fool you; inside the courtroom she is a fierce beast to be reckoned with. I watched in amazement first hand how she worked and the amount of respect she commanded from everyone in the room. There hasnt been many genuine human beings that would stick their neck out and fight this hard for me, she is one i will never forget. She is a true professional and i would personally recommend her to anyone.

Terrible experience with a Terrific outcome. Kai Li, YOU ARE AMAZING!
Unfortunately i have needed legal help...An when it came to my life i wanted the best obviously. After much due diligence and assistance from family i was referred to Kai Li. Honestly i had no idea what to expect, i was at the point of borderline insanity, and Kai Li was soo informative, so transparent and upfront with me and really helped me understand EVERYTHING i was to expect. I listen to stories about how people couldn't ever reach their attorneys, they didn't know what was going on, they weren't making much effort...NOT the case here. An i am sure i was a pain in the rear but, Kai Li was always available and if she was in court or busy, (by the way she always returned my calls promptly) she would let her partner Mr. Eisenberg know what was going on and he would help me in areas he could. Kai Li seems to be known by most everyone that we would run in to or walk past and has a great network from what i saw. Every question i had was answered but, she doesn't sugar coat! Sometimes i wanted her to cause i was terrified but, she is always 100% honest and forthcoming yet very caring and understanding. Even when i was having a breakdown...which i had often. One thing i loved about being represented by Kai Li is i got the genuine feeling that she actually cared about her clients and about my situation. Now, i would like to say i am great at understanding people considering i have to read reactions on a daily basis...Well, i still stand by this when i say it, "Kai Li has your best interests in mind at all times." Plus when my family had questions she would gladly take their calls too, which ment a lot to me cause they were just as nervous! When it came to payment, her office is terrific and very accomidating. Hard to find from what i experienced. Overall she made one of the worst times in life a quick and educational experience. Ha, i learned my lesson and she gave me my pep talk and i appreciate everything she said to me "off the record" so to say. I would never call anyone else to represent me in this area besides Kai Li. Most of the attorneys i spoke with sounded great in the beginning or sound helpful but, i can assure you; from experience, that it's hard to gauge at first. I'm giving this review because i can honestly say that without her help, i wouldn't be in front of a computer right now, nor would i be sitting here with a smile, i would be in jail. I figured the least i could do is a review. My suggestion for anyone in need..."Call Kai Li...that's it. Call her and you will know why i wrote this." Thank you Kai Li! So much!
