Disengaged, ineffective and lied about an intern not using billable hours

Hired Jonathan Dunn for a custody case. When I hired him, I asked what the billable rate for his paralegal would be. He responded that his paralegal was a legal intern and typical paralegal work would not be billed. Not only did I not get paralegal rates but he had neither and billed at his rates ...for all work. Very simple stances and communication were missed repeatedly to the point that a large portion of my billing went to explaining things to him that we had already went over ad nauseum. All this would be fine if he did a good job but he didn't. He was disengaged. Not aware of the facts of the case when he needed to be. He didn't challenge a single thing that opposing counsel brought, he admitted they were wrong but was saving up for just the right time...to not challenge anything later either. Opposing counsel quickly noticed and outright bullied Mr. Dunn for the duration of the case to the point that another lawyer knowledgeable about the case said "surely it's because he doesn't have family law experience." Spoiler, he's been practicing for decades. I'll say, Jonathan seems like an intelligent guy. I believe he would have been *at least* more effective had he given this case a reasonable amount of care. But the results are the results. He didn't just miss the mark. He missed the whole side of the barn with his representation. Edit - To Jonathan's response, I wish he had been that compelling at any point in the case but it's still outright disingenuous. I settled the case with a bad outcome because it was clear that Jonathan was ineffective and this was no secret to Jonathan. For him to imply that I got the results I wanted is outright unethical. For background, the biggest issue for us in the case was me telling my son that it wasn't OK for his mother to PHYSICALLY ABUSE him or prevent him from talking to me. Could I have addressed it better? I'm sure...But this guy had physical abuse documented from no less than 4 credible sources and needed to overcome me telling my son that wasn't OK...and he still failed. I asked him about hours from the supposed intern multiple times and he never provided that there were any worked by them or even so much as confirmed that the intern helped whatsoever other than in response to this review even though I asked multiple times. Jonathan is a lawyer and couldn't even get through his paragraph response without multiple typos. That's reflective of the quality of the rest of his work.

This case was resolved by consent order. Chris' failure to comply with the Court's orders or fully apprehend the significance of his contumacy presented challenges, but the case was utlimately reolved by terms requested and approved by the client. The firm was fortunate to have a summer intern during a portion of Chris' case who was able to do work for which the client was not billed. This was not in effect for the duration of the representation--as is the case with summer interns. I am glad that we were able to pass some of these savings on to Chirs, and I am pleased that we were able to attain a final disposition that met with his approval. Of course, Chris was free to seek counsel elsewhere or dismiss the firm if he had the slightest reservation about the calibre of his representation. His decision to keep the firm on retainer throughout the pendency of his case speaks volumes, and we are pleased that the matter was resolved by terms agreeable to all parties.
