Giltex Corp. v. Diehl, 544 So. 2d 302 (Fla. 1st DCA 1989)
In a case still cited by others today the First District Court of Appeals reversed the trial court in favor of Mr. Clinard's client and remanded the case back to the trial court for further proceedings, which ultimately were successful for the client.
