In my opinion this review is inappropriate and should be removed by Avvo, because it is clear from the author's own writing that Mr. Lipshutz was neither retained nor formally consulted - i.e. no compensation was paid to him. As such, it appears to violate the Terms of Use. And in any event, it is unfair and unreasonable for one who has no meaningful, firsthand experience WORKING WITH a professional to publicly opine about him or her - or for Avvo to allow such publications. For what it's worth, to my knowledge I have never met Mr. Lipshutz, have never worked with him and have absolutely no vested interest insofar as his reputation is concerned. I merely sympathize with him as a fellow lawyer in the community who has at times been extremely busy with court deadlines, trials, travel, illness, death in the family, etc. and, due to the extremely limited time I already have for existing cases, emergencies, etc., may occasionally choose not to respond to an inquiry or communication from someone whom I know either cannot or will not retain me. Said another way, while I try my best to personally respond to every person who contact me, there are rare times when I simply do not have the time or ability to do so for one of many various reasons. That's just part of the reality of being a small business owner (in my case, a solo practitioner) and consumers/potential clients should understand and appreciate this and not take it personally. On the other hand, it is completely unacceptable for an attorney to fail to respond to calls/emails, etc. from an EXISTING client within a reasonable amount of time (e.g. 12-48 hours) barring a true emergency/actual inability to do so (or after having given notice to the client that the attorney will be unavailable for a period of time due to travel, etc.). And any attorney who fails to timely communicate with his or her client (barring a rare exception as noted above) deserves to be reviewed poorly (but this is not one of those situations). ALG
