Good, Bad and time in-between Mr Payne has your back..bet.

This man is the 360 defense offensive jewel of the Nile. In my darkest, complicated, holiest of terrifying time in my life, know Mr Payne had my COVID limbo, who knew when it would end, pending case covered. I should have been a hell of a lot more nervous and concerned about how it would all play out... but putting the pieces of my life in some sort of working order took every ounce of keeping my head together that I could gather. My situation was rather complicated, had caused myself an enormous and swift amount of loss and sacrifice that consumed my world. But whenever I had a moment of "Reality, I still have a trial to face"..there were no moments of panic, fear or questions of if I was in good hands, just pure peace of mind that my lawyer was going to make sure that his approach to the case never waivered away from my best interest at heart. There are no words for the comfort that had brought my twisted up world. I will forever be in his debt for the dedication he had for me as a client. Not a win. Not a chance to showcase. His goal was consistant in me going forward to a life of normality with my head still in tact. And that's exactly what he did more than two years after my charge by the state. (COVID interceptions to blame) Not all heroes wear capes. But John Payne kinda should :)

Great lawyer

Mr. Payne was appointed to my case, and all the time that he called and spent with me was after hours. Very efficient and helpful all throughout my case. I highly recommend him and with all his hard work he got my case dismissed. If there was a 10 star option i'd give him a 10.

incompetent and lazy

I agreed to allow Mr. Payne to represent me on a criminal case where I was arrested and charged with several battery charges along with an obstruction charge. This was after my daughter called the police for giving her a spanking. On my first meeting with Mr. Payne I gave him the details of the... incident. Although he listened me give him the details, he had already spoken with the prosecutor and had a plea waiting to give to me. After listening to me, he then showed me the plea from the prosecutor and said "This is a great plea, I think you should seriously consider it". Since this was our first meeting, I told him that I didn't know my legal rights regarding spanking my children and that I wanted him to do the legal research to find out if I was within my rights. I told him that I specifically wanted to see how judges ruled on similar cases. In addition, I reminded him that I am innocent until proven guilty (beyond a shadow of a doubt). I asked that he file the necessary motions to have all proof that I had broken the law presented to me and if the lacking, to have the case dismissed. Over a period of two months, Mr. Payne would only ask me to "take the plea". Never did he do any legal research, and never did he file any motions. I asked him to pull the records of the police officers that were involved and he stated that "this case does not warrant that". He told me that child abuse could be as simple as "brushing your hand against your child's bottom even if it didn't leave a mark and obstruction could be as simple as tossing a business card at someone". Both are inaccurate based on the opinions of judges and legal scholars. Over the two months of me allowing Mr. Payne to represent me he only had one agenda, "take the plea". He wrote an email to the prosecutor and accidentally copied me on it and stated "this guy thinks I'm going to represent him like Johnny Cochran". Was I wrong to think that I deserve the best representation? He eventually asked the court to be dismissed from the case (which the judge granted) and I found a much more competent lawyer. One of the worse things that I remember from dealing with Mr. Payne is when I asked him when my court date was and he responded (by email), "I don't know, I haven't received any notices. I then asked the prosecutor myself and he told me the exact date and showed me when Mr. Payne received the notice. I would advise anyone in need of an attorney to stay miles away from Mr. Payne. He only wanted me to "take the plea", he misrepresented the law, he was unprofessional in dealing with myself and the prosecutor, he failed to file motions, he failed to tell me when my court date was and when I brought these facts to his attention, he requested to be dismissed from my case. End the end, he only add more stress to an already stressed situation.

I strive to serve every client to the best of my ability and in the best interests of that client. To fulfill this goal I work seven days / week almost every week. I Always put Clients' Interests above my own, centered on Risks to my client. Risks in criminal defense cases include potential incarceration (liberty and freedom), and Financial Impact. This client specifically requested a Motion to Dismiss. I was not able to identify a basis for dismissal early in the case cycle, after Arraignment. Whether I want to file Motions or go to trial is immaterial if it does not serve my client. In this case, I researched the issues and found that the central question (extent of acceptable corporal punishment) was a question for the fact finder (a judge or jury). I spent hours on Case research, usually during evenings and on weekends. I did not report the number of hours I spent on this research to this appointed client. I sincerely regret that my research was not acceptable to this client. That has not happened to me in any other case. In applying Risks in this case to this Client, I did recommend a plea and explained my basis for the recommendation. I regret that this client found that unacceptable. When my client made it clear he would not plea, I did not attempt any further negotiation with the State, but filed a Motion to Withdraw, in hopes that my client could receive a different appointed lawyer that might be able to meet the client's needs. . I am grateful that this case turned out well for my client when he was able to obtain, with another attorney, a form of Plea, called Pre-Trial-Diversion, which is more beneficial than a Plea. I learned a lot from this client, and will apply what I learned in this case when it applies.
