J. Ashley Twombley practices in the areas of complex commercial and serious personal injury litigation, regularly handling cases for clients involving wrongful death, breach of contract, estate and probate contests, and products liability. Mr. Twombley’s clients include plaintiffs and defendants, as well as individuals and corporations.
Mr. Twombley earned his B.A., cum laude, from Clemson University in 2000. He earned his J.D., cum laude, in 2003 from the University of South Carolina School of Law. During law school, Mr. Twombley served as the Managing Editor of the South Carolina Law Review, was a member of the Wig and Robe, Order of the Coif, and the SCTLA Trial Team. Mr. Twombley also received the CALI Award in Contracts.
After law school, Mr. Twombley clerked for the Honorable Margaret B. Seymour in the United States District Court for the District of South Carolina. While clerking, he assisted in managing one-third of Judge Seymour’s docket, including the judicial resolution of a nation wide class action and various other complex commercial litigation matters.
Following his clerkship, Mr. Twombley joined the Atlanta office of King & Spalding. King & Spalding is an international law firm with over 800 attorneys and offices throughout the world. While at King & Spalding, Mr. Twombley represented Fortune 500 companies in high exposure product liability, toxic tort, and personal injury cases across the country. King & Spalding's tort litigation group is widely knoen as one of the top litigation groups in the nation.
After his time with King & Spalding, Mr. Twombley moved to Beaufort, South Carolina to open Twenge + Twombley, LLC. In his first three years of private practice, Mr. Twombley has represented a variety of litigants across the southeast and has tried cases in state and federal courts as well as represented clients in the Fourth and Eleventh Circuit Court of Appeals. Mr. Twombley has also represented clients in arbitrations before the American Arbitration Association, JAMS and FINRA. Some recent examples of Mr. Twombley experience includes:
· Serving as lead Plaintiff’s Counsel in a 42 U.S.C. § 1983 wrongful death action against twenty-seven defendants which was successfully resolved after four years of litigation. After Plaintiff survived summary judgment on its deliberate indifference and medical negligence claims, the case was settled by the defendants at mediation. The defendants in this case requested that the terms of the settlement agreement remain confidential.
· Obtaining summary judgment in federal court on behalf of a Defendant in an anti-trust suit alleging that the Defendant violated the Clayton Act, Sherman Act and South Carolina Unfair Trade Practices Act.
· Securing summary judgment on behalf of a Plaintiff in a shareholder stock transfer suit.
· Securing the dismissal of an appeal filed before the South Carolina Court of Appeals and the dismissal of a writ of certiorari filed before the South Carolina Supreme Court in a breach of fiduciary case.
· Serving as Plaintiff’s counsel in several wrongful death suits against corporate defendants.
· Serving as appellant counsel for clients before the Fourth and Eleventh Circuit Court of Appeals.
· Representing a national bank related to breaches of commercial banking contracts.
Mr. Twombley also has an active pro bono practice, regularly representing clients with civil rights claims related to mistreatment in prison. Mr. Twombley has also received special appointments by South Carolina Federal District Court judges requesting that he represent prisoners proceeding pro se in § 1983 cases.
