Practice areas
  1. Estate planning
    50%
Estate Planning is the process of planning how all the things one accumulates during a lifetime are distributed and handled following a person’s death. While there are many factors determining the complexity of the estate planning process, each can be simplified with the guidance of an experienced North Carolina estate planning lawyer. Regardless of age, planning for your family’s future in the event of your death or incompetency should be a stress-free process with professional guidance.

  2. Litigation
    30%
Litigation is the process of resolving a dispute by filing a complaint between individuals or businesses through the court system. Litigation can involve multiple areas of the law and is necessary when an agreement or initial negotiation will not resolve the dispute. I represent both plaintiffs and defendants and will manage the entire litigation process, including investigation, pleadings, discovery, trial, settlement, and appeal.

  3. Business
    10%
Whether you are just starting out or looking for ongoing legal support for your established business, I can help you interact with the public, other companies, and the government through contracts, negotiation, and transactions. From entity formation to selling your business, business law encompasses a variety of legal disciplines to help protect your business every step of the way.

  4. Corporate and incorporation
    10%
The creation, organization, and dissolution of corporations are governed by the state in which they have been incorporated within, with regulatory laws varying from state to state. Because of this, corporate law is complex and needs to be approached by an experienced corporate lawyer. I am proficient with the creation of joint ventures, licensing arrangements, mergers and acquisitions, and numerous other transactions necessary for the smooth and successful operation of a corporation.

Peter McGuire has been practicing law in Western North Carolina since 2002. A native of Asheville, Peter is proud to call this area home and feels a deep responsibility for its people and places. Prior to practicing law, Peter worked as a fly fishing guide on the waters of Western North Carolina and Western Montana.

Peter began his practice at a large law firm in Asheville in 2002 practicing primarily insurance defense and professional malpractice defense. In 2008, Peter formed a solo firm focusing on environmental law and general practice. In 2011, Peter joined Wimer & Associates as a litigation associate, which allows him to practice in varied legal areas and on myriad cases ranging from class actions and insurance matters to catastrophic injury and property disputes.

Peter is a 2002 graduate with high honors from the University of Montana School of Law. He holds a B.A. in religion from Davidson College, which he received in 1996. He is admitted to practice by the North Carolina State Bar, the United States District Court for the Western District of North Carolina and the Eastern Band of the Cherokee Nation Tribal Court. He is a member of the North Carolina Bar Association in both the Litigation and Environmental Law Sections, and a member of the 28th Judicial District Bar. He was honored by his peers in 2009 and 2011 and listed in Business North Carolina Magazine’s Legal Elite, and is an inaugural member of the Harry C. Martin American Inn of Court.

Peter has served as a member of the Board of Directors of EnergyXchange, a non-profit organization for the research, promotion and utilization of renewable and alternative energies, primarily landfill gas capture, since 2011. From 2003-2009 he was a member of the Mission Health Systems Institutional Review Board. Other community affiliations include past memberships on the boards of Asheville Affiliates and Asheville Downtown Association, Downtown After Five Series. He has served as Legal Counsel to the Asheville Brewers Association since 2009.

Estate Planning
After a very difficult year and 5,000 mile relocation to NC with my two small children, I was very nervous about my financial future and protecting my children's future. Peter facilitated this transition and guided me through the estate planning process. It was a relaxing and very professional atmosphere. Peter pointed out other aspects of financial planning that I had not even considered and put me in touch with several other professional associates. The process went very quickly. Directions were complete and thorough. I look forward to a long relationship with this firm.

estate planning
In the handling of my estate and personal legal concerns Peter McGuire has suggested different courses of action, and explained each in a manner that is understandable. Within the direction I decided upon, my concerns were addressed, the consequences of each course of action explained, and the final documents have been prepared promptly. P ayment was not accepted or asked for until I was satisfied.

trust
When I finally found Peter I had met with Three other attorneys and after six weeks had been no further on in setting up two trusts for my wife and I. I was frustrated and could not believe the lack of professional courtesy. The first meeting with Peter was very informative and totally relaxing. I explained what I was trying to achieve and he took the ball and ran with it. By the second meeting (just one week later) with my wife the trust was ready to be finalized. One week later our trusts were complete and Peter throughly reviewed the trusts again with us. I'm extremely impressed with Peter's concern that our trusts were drawn up properly and that they addressed all our concerns and needs.

Responsive and helpful
I met Peter on very short notice; that is, I needed the advice and counsel of a litigator very quickly, and Peter chiseled a hole in his schedule to see me within two days. Within that two day period, he had thoroughly reviewed a good deal of documentation on a complicated Trust matter, and so was prepared no only to hear me out, which was all that I had expected, but to offer suggestions and advice on the spot. His suggestions were clear, and could be easily implemented. I was required to take action within a matter of days, and Peter reviewed and followed through on the work that had been done, catching things that I had missed after hours of review. I enjoy working with Peter, and hope to do so again.

Business Purchase
Peter McGuire was very thorough and explained all the paperwork involved in language that was easy to understand. Very helpful in making suggestions and open to our suggestions as well. He made any changes that were required in our paperwork to make sure all parties involved were satisfied with the decisions that were made. Everything was handled professionally, respectfully and courteously.
