My name is Phil Gibbons and I limit my law practice to employment law and long term disability claims on behalf of employees. The one thing you should know about me is that I am a cancer survivor. In 2010 I was diagnosed with Stage III Hodgkin's Lymphoma. I endured 6 months of chemotherapy and overcame many challenges before being told I was "cancer free." I not only understand how a life-changing event can impact employment, I have lived it. Although my law firm obtained a very favorable settlement for a former client, I received this review after this individual threatened she would harm my reputation if my law firm did not pay her money. We refused. Although the review was posted “anonymously,” a federal court Judge issued a written decision approving the settlement this former client complains about, including the amount of attorney’s fees paid to my law firm. See Sharon Blackmon v. Cohen, et. al., 2020 WL 91914 (MDNC Jan. 8, 2020). The Judge’s decision contains a detailed discussion explaining why the settlement terms are fair and reasonable. The lawsuit involved the alleged failure to pay overtime wages. The Judge found that: “the settlement amount of $11,625.00 for unpaid overtime wages and $11,625.00 for liquidated damages represents approximately 93% of her estimated unpaid overtime and liquidated damages over the three-year period preceding the lawsuit.” The client received 100% of this money – the attorney’s fees paid to my law firm were paid separately. Regarding the legal work performed on behalf of this client, the Judge stated: “having attorneys skilled in FLSA litigation, particularly at least one attorney who has served as lead counsel in numerous federal wage and hour disputes, was crucial to obtaining relief for Blackmon – 93% of her estimated unpaid overtime work for the three years preceding this lawsuit.” Regarding attorney’s fees, the Court found: “there is no reason to reduce counsel’s requested fees. First, there are no unsuccessful claims. . . Next, counsel themselves have already significantly reduced their fees – from $33,400 to $19,750 – to facilitate settlement. Accordingly, their requested fees and costs are reasonable.” Bottom line, we obtained a great result for this former client. She received $23,250 (approximately 93% of the total amount possible if we won a jury trial) and my law firm received $19,750 (which is a significant reduction of the total fees we billed to the case). I do not deserve the review posted above and disagree with what was written. Luckily, you do not have to decide who is telling the truth because a federal court decision sets the record straight.
