Tone-deaf and Unempathetic

I reached out to Robert Jenner’s firm seeking legal guidance and support after experiencing what I believe to be serious medical misconduct during childbirth, an extremely vulnerable and traumatic time. Unfortunately, my experience with this firm left me feeling dismissed and disappointed. Rather ...than approaching my case with empathy or curiosity, I received a response that seemed to minimize the severity of what occurred. The reply conveyed that unless my injuries were visible, catastrophic, or life-ending, my experience wasn’t worth pursuing legally, despite it involving non-consensual physical contact during labor, a deeply personal and human rights-based violation. While I understand the legal thresholds for malpractice cases are high, I expected more than a transactional, checkbox-based approach to such a sensitive issue. To add to the discouragement, I was advised to “lose the AI-generated email,” a comment that felt tone-deaf and beside the point. I wasn’t looking for a critique of my writing style. I was looking for advocacy, support, or at the very least, acknowledgment that what happened deserved better than a quick dismissal. I hope this firm reflects more deeply on how it communicates with people who reach out in moments of pain and vulnerability. Legal merit is one thing. Respect and compassion are another.

Thank you to the law office of Mr. Jenner.

Jenner law office and Mr. Jenner helped me when I had no one and in pain after a device was put in my body that was not yet clear to be safe . I was wrongfully treated by a doctor and a companies device that i had to hire an attorney because what was done to me physically hurt my body and will cause ...me problems for the rest of my life. I got some restitution for my injuries that has helped with medical needs and a different way of life for me out in the working world. Because of my injuries i will never be able to work a normal job that I use to . I thank them emencely for all he and his company has help me with. I feel they did a very good job. Lacks professional ethics and lies to his clients

Robert Jenner represented me in an Essure lawsuit and it was a HORRIFIC experience. On top of all my injuries and suffering, having my own attorney blatantly lie about facts I can prove and keeping $45,250 from me because of his lies should be illegal!

I’m very sorry you feel this way. Your Essure settlement, as the settlement from all our clients, is reviewed by a law school professor who specializes in mass tort settlements, ethics, and professional responsibility. Your settlement was handled according to the strictest standards of professional ethics and was processed according to the law and our contingency fee agreement with you. I’ve explained the settlement to you in writing, both by letters and emails. I’ve asked to speak with you on the phone to discuss it verbally and you have refused to speak with me. I’m not sure what else I can do to explain how a personal injury settlement works. We negotiate a settlement on behalf of a client. From that settlement amount, you must pay an attorneys’ fee, the costs of the litigation, and any health care liens you may owe. Those terms are spelled out in every contingency fee agreement we enter with our clients; your case was no exception. Rest assured we did not hold back any money from you that you were entitled to. Every person who suffers a similar injury gets the same amount of money in the Essure litigation. In other words, a person who suffers a condition that is not related to the Essure device cannot get more funds; there must be a causal relationship between the injury and the device, and there must be an expert to support such a relationship. In your case, you obtained the same amount as others in your position. Indeed, as a contingency fee law firm, we receive more when you receive more. We have every incentive to maximize your recovery. However, there must be equity to the process, and a client cannot receive more money that others in the same position. And, of course, no client is compelled to take a settlement. Any client who is unhappy with a settlement amount is certainly free to reject that settlement offer and seek other legal representation or proceed to trial. That right was available to you, as well. Again, I remain open to discussing the settlement with you, and for you to have an advisor of your choosing with you during the conversation. It’s critically important to our firm that you understand the settlement process. He's really knows how to fight the big drug companies -- a big consumer advocate!

I knew Rob when he was just starting out in practice, suing companies that distributed tainted blood products that gave people HIV. He had fire in his belly back then, and he's never lost it. My case involved the hormone therapy replacement drug Prempro. Rob and his team fought the big pharmaceuti...cal companies and won settlements for those of us who were hurt. Not only that, but he forced the drug off the market. I have a chronic heart condition because of Prempro, but at least the settlement has given me some financial security. I can't recommend Rob enough for anyone who has had a debilitating and permanent side effect from a drug..
