OUTCOME: The U.S. Court of Appeals for the Fourth Circuit reversed the District Court.

Mr. Brennan represented the insureds in an insurance coverage dispute with their insurance carrier. The Fourth Circuit reversed the District Court's judgment granting the insurance carrier's motion fo ... r summary judgment on the issue of whether the carrier had a duty to defend the insureds in underlying litigation. The Fourth Circuit ordered the District Court to enter summary judgment in favor of the insureds on the issue of whether the two insurance policy exclusions on which the District Court had relied provided a basis for the insurance carrier to deny a duty to defend and remanded for further proceedings consistent with the opinion.

The case primarily involved an issue of st ... atutory construction, as well as issues of whether the trial court abused its discretion in connection with rulings relating to the plaintiff's expert witnesses.
