OUTCOME: The trial court was affirmed

The trial court was affirmed both as to issues raised by Brown & Sturm on appeal of the trial court's holding Brown & Sturm was not entitled to enforce its retainer agreement to collect fees in additio ... n to the approximately $1.7 million previously paid. The trial court was also affirmed as to its rulings in favor of Brown & Sturm, which were challenged by the Defendants in a cross-appeal, such as whether the trial court had erred in holding that Brown & Sturm's claim was not barred by collateral estoppel and whether the trial court had erred by not holding that Brown & Sturm's fee agreement violated the Maryland Rules of Professional Conduct.

A four member majority of the seven member Court of Appeals held that the record in the case contained disputed facts relating to the statute of limitations which made summary judgment inappropriate. ... The dissenting judges believed the majority had overlooked undisputed facts which established as a matter of law that lthe statute of limitations barred the claim and would have affirmed the Court of Special Appeals' affirmance of summary judgment in favor of the defendants.

OUTCOME: The trial court was affirmed

The Igwilos had a dispute with Maryland's Property and Casualty Guarantee Corporation, which took over as ithe insurer when P.I.E. went into receivership, over whether their medical malpractice complai ... nt presented more than one claim under the applicable statute and under the P.I.E. insurance policy. The Property and Casualty Guarantee Corporation took the position that the Igwilos' lawsuit presented one claim, and the Igwilos took the position that their lawsuit presented three claims. The trial court held that the Igwilos' lawsuit presented two claims, and the Court of Special Appeals affirmed.

The Court of Appeals affirmed the trial court and the Court of Special Appeals. The Court of Appeals held that the plaintiffs claims against the defendants asserted in the complaint were properly dism ... issed with prejudice, as beneficiaries of estates lack standing to sue attorneys retained by the personal representatives of estates. The Court of Appeals, like the Court of Special Appeals, also rejected the plaintiffs theory, asserted on appeal, that they had an attorney-client relationship with the defendants because the defendants had communicated with them regarding the estate while repreeenting the personal representative.

An administrative agency, the Board of Physician Quality Assurance, and the trial court on petition for judicial review, had found that Dr. Banks engaged in multiple instances of unprofessional conduc ... t in the practice of medicine based upon his interaction with co-workers of the opposite sex in the workplace, but the administrative agency imposed only a reprimand on Dr. Banks and his medical license was not suspended . The Court of Special Appeals partially reversed the administrative agency, holding that two of the three instances of conduct were not "in the practice of medicine," which was the sole issue on appeal.

The bankruptcy debtors sued the lawyer defendants for multiple torts and sought rescission of the lawyers' fee agreement in an adversary proceeding brought in U.S. Bankruptcy Court. The lawyers also s ... ought to recover the amount of their fee that had not been paid as a claim in the bankruptcy. The Fourth Circuit affirmed the judgment entered by the Bankruptcy Court after a trial that the negligence and related claims against the lawyers were barred by the statute of limitations and also held that the debtors' intentional tort and rescission claims were otherwise without merit. The Fourth Circuit also affirmed the Bankruptcy Court's judgment denying the lawyers' claim for additional fees, as the court found that the approximately $1.7 million the attorneys had already been paid under the fee agreement was reasonable payment for their services under the relevant Bankrupcty Code provision.
