Most small businesses don’t survive Chapter 11. We did survive and much of the credit goes to our attorney, Rob Bovarnick. His business expertise was invaluable in developing our restructuring plan and his bankruptcy expertise was critical in getting us quickly through the process. Completing the ...process quickly was essential to our survival. As a result, our business today is strong and the bankruptcy is a fading memory. As a small (20 employee) professional-engineering firm, we had undertaken a multi-million dollar design-build construction project that was cancelled in 2003 when the customer decided not to build the plant. By 2004, we were not only heavily in debt owing to non-payment of our design and engineering services for the project, but we were also facing numerous lawsuits from equipment manufacturers of custom components that we had ordered. A lawsuit against our customer ultimately yielded a settlement for pennies on the dollar. By 2004, Chapter 11 was our only viable alternative. Rob Bovarnick filed the bankruptcy petition which immediately stayed all litigation against us and blocked credit-collection activities, allowing us to continue doing business with our other customers. With Rob’s leadership, the reorganization plan was completed and was approved by the Court before the end of 2004. The case was closed in 2005 and over the next 5 years, we completed making all required payments to creditors under the plan. Bankruptcy is a last-resort alternative that no business CEO anticipates. Had Rob been our attorney prior to 2004, we might have avoided the pitfalls of the cancelled project. However, once we reached the point of no return, retaining Rob Bovarnick was one of the best decisions we ever made. We admired both his expertise and his sense of humor during the dark days of 2004-2005, and we do not hesitate to strongly recommend him to other business executives in need of an excellent business attorney.
