Josh assisted me with a matter where a previous attorney had committed fraud and malpractice, thereby putting me in serious financial jeopardy. Josh came to the rescue and worked tirelessly until the case was resolved and closed. He represented me brilliantly in all aspects - against the plaintiff ...and against a major national bank which had illegally put a hold on my funds. Josh responded to my emails, phone calls to his office and even to his cell phone at all hours, including weekends. He was relentless in pursuing the previous attorney to fully compensate me for all losses I suffered as a result of his prior negligence. Josh is a skillful negotiator, and at the same time very mindful of the legal costs to his client. I hired Josh to help with a review and negotiation of a contract -- particularly, with the non-competition clause of the contract. Josh took on the project in a timely manner and thoroughly researched the precedents for these clauses in the state the contract will be governed in, including contactin...g the state's congress-person regarding new legislation that could impact this contract. To me, the key aspect that sets Josh apart from other lawyers is his incorporation of actual litigation experience in informing decisions and strategy with regards to contract negotiations. Mr. Upin started my case with a thorough background investigation, both of the opposing party, and the facts of the case, to make sure we knew where we stood. He discussed possible strategies with me, and actually recommended against a full-blown lawsuit due to expense and time frame. He came up with... alternate strategies for applying pressure without filing an actual lawsuit, and in the end, the other party (who did not have a leg to stand on, yet was full of bluster) caved in completely to our demands. During this process, Mr. Upin was very communicative and collaborative. Also, he erred so far on the side of disclosing possible conflicts of interest (his father happened to know one of the parties that was tangentially-related to the proceedings -- it wasn't even actually the opposing party, but Mr. Upin wanted to know if I was uncomfortable with his father knowing this person), that it was both comforting and amusing at the same time. Obviously, one would prefer to not have to deal with matters like this at all. But since sometimes you do, you couldn't really ask for a better outcome or process than I had with Mr. Upin. He is smart, knowledgeable, and honest both in trying to keep billing down, as well as all other ethical matters.
