Disappointing

Unfortunately this client was disappointed with the results of their DWI charges. Disappointment is when someone's expectations do not meet reality. The reality of what happened in this case, and what the client believed happened, are at odds. This was an aggravated DWI case. This means that the breath test was over .18 BAC. The reason for the police stop of their car was multiple moving violations with speeding. The client submitted to police field sobriety tests. The cumulative facts of this case were highly unfavorable to the client. The Truth I never promise anyone I can get their DWI case dismissed. In the majority of DWI cases, a dismissal of the charges by the prosecutor is extremely unlikely. This case had aggravated DWI charges that would most certainly not be dismissed. There were delays in this case. The delays were due to the client not submitting to a required drug/alcohol evaluation in a timely manner. The DA was not pressuring anyone to accept a plea deal. The DA made a plea offer. I explained the positives and negatives of the offer. The client decides whether they want a trial or to accept the offer. I do not threaten or pressure people to accept plea offers. I do not leave anyone standing in a courtroom after they are sentenced. I walk out of the courtroom with my clients, and explain all their paperwork. The Process In our practice, we follow a process. It involves providing the client with a “things to do” list at the very beginning of that case. We provide support and guidance with their license, the court process, and their drug/alcohol evaluation. We also finish out all our cases with a final summary. This includes a checklist of things to do, and is very comprehensive. We also include information on all programs that the client will need to take or tasks to perform. The Reality In this case, the plea offer was a reduction from an aggravated DWI to a regular common law (no BAC number) DWI. The plea offer included a sentence of a CD (conditional discharge). This is the lowest level of punishment for a DWI. A conditional discharge is a “stay out of trouble” order for one year, a very favorable outcome considering the nature and level of the charges. In this case, there was no term of years of probation, supervision and monitoring. There was no treatment recommended or required for alcohol abuse. In this case as in every New York DWI case, there is a mandatory one year ignition interlock device placement on their car. In this case, six months after the ignition interlock device was on their car, at the client’s request we petitioned the court and county monitor for an early release. That petition for IID release was successful, and an early release was granted by the judge. I only promise my clients that I will do my best with the facts and circumstances before us. I also work very hard to ensure that my clients feel I have their best interests in mind. In this case, this client did not feel that was true. For that I am truly sorry.
