Good attorney , overbills clients
Brian is short tempered, and unfriendly. He has an old style approach that everything must go to trial. While he is good, he seems as if he can’t negotiate, it’s always worst case scenario. He gives quotes and while I expect him to sometimes go over them. He bills excessively and at one point charged...
Without knowing who this client is, I cannot address his/her personal experience as described above. I can speak generally, however, and will start by saying that the client's perception that I cannot negotiate, so all cases must go to trial, is mistaken. The vast majority of matters our office handles are settled to our clients' satisfaction. The only cases which do go to trial are those where a satisfactory settlement cannot be achieved, which can occur for a number of reasons - the most common being where a party makes excessive settlement demands, and the opposing party chooses to let a judge decide the matter rather than giving in to those demands. Regarding the "worst case scenario" comment, we always present our clients with an honest and realistic assessment of their case. That means explaining both the best and worst outcomes, and the likelihood of where a client's case would fall between the two. Sometimes the facts of a client's case warrant advising that a poor outcome is probable, which is advice clients don't always want to hear - but which they need to hear if they are going to make intelligent decisions as to how they would like to proceed with settlement or trial. If this client feels he/she was billed excessively, we would be happy to discuss the issue. We strive to be accurate and fair in every aspect of our billing, and make it known (in writing) at the outset of our representation that any questions or problems with a bill will be addressed promptly and at no charge to the client. And while a standard Retainer Agreement does contain a provision for interest on unpaid accounts, as a professional courtesy we rarely apply it. We will work with clients struggling with finances; however, sometimes it becomes apparent that a client simply has no intention of making payment, such that agreed-to interest is then applied on his/her bill. Again, this is a rare occurrence. Lastly, as to the "short tempered and unfriendly" comment, those aren't words most clients use to describe our time working together, and without knowing this person's particular experience it is hard for me to address the comment. One thing I can say is that sometimes the client's and attorney's personalities just are not a good fit. Perhaps that was the problem here.
