Hello James - I am sorry that you felt unsatisfied, but as you know we do not choose how a Court handles their conferences. The Court decides whether the conferences are held attorneys only or not, we do not get to decide that. When an adversary is unreasonable, a matter goes on longer than it should if we do not immediately move the matter to Court because the negotiations go nowhere, which increases legal fees. However, I can only advise, our clients ultimately make the decision. By not immediately moving the matter to Court it allows the other side to delay, causing unnecessary and increased legal fees. While I understand people are hesitant to go to Court because they feel that increases legal fees, it actually saves legal fees because a timeline gets put in place that moves the matter along. Your frustration is understandable, but we advise and make recommendations to move a matter along quicker and with less legal fees - ultimately our client makes the decision on whether to follow them.
