Breach of Trust, Lack of Accountability, and Severe Client Harm

I was a 20-year legacy client of Kobrick & Moccia, LLP, trusting them to manage my family’s estate. My experience with Anthony Michael Moccia was profoundly disappointing and harmful, both financially and emotionally. After signing a retainer with the firm in January 2024 and paying $17,500, I expec...ted professional handling of the estate. Instead, I received no meaningful accounting of where those funds went. The only “inventory” provided was a blank template, and there was never any follow-up despite my repeated requests by phone, fax, email, and certified mail. The lack of communication was extreme and left me in the dark during critical points of the case. Important deadlines were missed, sometimes without notice. On July 15, 2025, the Surrogate’s Court itself had to issue a “Dear Counsel” letter under Rule 207.20 addressed to Mr. Moccia, not me, because filings and updates had not been properly managed. To this day, I cannot determine what funds, if any, may have been escheated due to this neglect. When I pressed for answers, I was told at one point that I had “fired” the firm. This was false. I never discharged the firm, nor did I have substitute counsel. As someone familiar with New York law, I know an attorney cannot abandon an active case without court approval. This excuse was used to cover abandonment, leaving me exposed to debt collectors and foreclosure-related consequences. I also made clear that I am a disabled client entitled to ADA accommodations. Rather than making any effort to ensure meaningful participation, Mr. Moccia and his office were dismissive and unresponsive. The failures were not only unprofessional but also discriminatory, adding an additional layer of harm. The toll has been severe. I suffered financial loss, delays in court, and unnecessary trauma. Even my financial advisors and bankers, who helped me with medallion guarantees and wiring funds, witnessed errors and delays that shocked seasoned professionals. What should have been a straightforward estate process became a drawn-out ordeal, driven by neglect and disregard. Ultimately, my experience reflects a breach of the most basic duties of an attorney: honesty, diligence, communication, and respect for the client. Whether by neglect or avoidance, Mr. Moccia failed to deliver the services I paid for and left me without answers or closure. For anyone considering this firm: proceed with caution. Legacy reputation does not equal accountability, and payment does not guarantee transparency or results. My trust in this attorney was deeply betrayed, and I cannot recommend him to anyone seeking responsible or ethical legal representation.
