talked to the lawyer on the phone. He is not very clear with how contingency fee was charged. We know the contingency fee is charged as 1/3 of the settlement. Sir: I feel bad that you walked away from our phone conversation feeling dissatisfied. I did my best during our ten minute discussion to answer all of your questions regarding the contingency fee breakdown. I obviously didn't do a good job. In 2014, there was a change in the law governing contingency fees in personal injury cases (see Title 22, sect. 691.20(e)(3) of the Official Compilation of Codes, Rules and Regulations of the State of New York). The new law mandates that the client must choose between two options: (1) if he/she elects to have the attorney lay-out any and all expenses, then the attorney's fee is one-third of the gross recovery; (2) if he/she elects to lay-out the expenses, then the attorney's fee is one-third of the net recovery. My retainer agreement clearly spells out these two options. In addition, I never told you that your wife had a bad case. You kept asking me about the two options, so I went into detail about how each works. I informed you that in situations where there is no recovery, whoever laid-out the expenses loses that money. Once again, I apologize for the confusion. I wish that the legislature hadn't changed the law because the options seem to complicate the matter. Unfortunately, I have no choice but to follow the law and offer the two choices.
