An attorney that won’t steal your six-figure settlement

All right, forget about trying to find the “best” attorney, because in reality most attorneys are pretty good at their discipline considering they all 1) had to pass the LSAT exam 2) were admitted into an accredited law school 3) successfully completed law school and 4) passed the bar exam. So, ...the quest for the “best” attorney might actually just lead you to an endless list of attorneys who are all equally capable and qualified to handle your case. So, now you might be thinking, “Well I want the best attorney because I want to win my case . . . “. Well, here’s something you may not have heard if you are not a professional plaintiff, every attorney wants to win every case s/he gets because most retainer agreements are structured to reward the attorney based on how much you, the plaintiff, are awarded either through a settlement or a verdict. So, put the idea of finding the best attorney to the side, because what you really need to focus on when searching for an attorney is: A) finding an attorney who is honest and will tell you about the merits of your case, the good and the bad, because you need to know what the other side is thinking. The most poignant thing Mr. Warshawsky shared with me is that the law was not designed for plaintiffs to win. You need an attorney who is going to tell you the brutal, but necessary truth about your case and our judicial system. B) finding an attorney who is transparent and willing to take the time to explain his/her strategy of ensuring your claim is within the confines of the law. Every injustice is not necessarily an injustice for a court of law. You need an attorney who can sift through your emotions and pull out the issues that can be addressed by the law. C) finding an attorney who is responsive to the defendant’s legal team, to the other officers of the court, and to you. D) finding an attorney who is not going to financially abuse you by charging you for every phone call, meeting, or answer to every question you may pose. E) finding an attorney who is not going to steal your money. Mr. Warshawsky represented me in a civil rights claim against my employer, which ultimately led to a six-figure settlement. As this was my first (and hopefully last lawsuit!) I had absolutely no idea that once a settlement was reached the defendant would pay the settlement directly to the plaintiff’s attorney. The plaintiff’s attorney is then responsible for deducting any outstanding fees from the settlement and sending the remaining balance to the plaintiff. Again, my case yielded a six-figure settlement so naturally I was worried that I might never see my money. But, Mr. Warshawsky didn’t fail me. He didn’t deduct any unexpected fees, he wasn’t tardy sending me my portion of the settlement payment and as a matter of fact he overnighted my portion and didn’t even charge me for the overnight express shipping fee. Mr. Warshawsky was honest, transparent, responsive, he didn’t try to abuse me financially, and no, he didn’t charge a “I get 60% of your settlement” retainer fee (which is ridiculous!). His retainer fee was modest, below the industry average and I got way more than the average settlement payout for like cases. You don’t need a good attorney; every attorney had to be put in a significant amount of effort to become an attorney. What you need is someone who is trustworthy, just like Mr. Warshawsky.
