    I handle litigation in all 3 areas of IP - copyright, trademark and patent infringement - and counsel clients on a wide range of issues: co-authorship, fair use, parody, infringement, damages, royalties, licensing and cross-licensing, copyright termination, digital rights, e-commerce, priority issues, patentability, etc. I welcome issues from all fields - scientific and technical endeavors, on the one hand, to the worlds of fashion, architecture, music, literature and journalism, on the other.

  2. Trademark infringement
    While I have handled very complex trademark infringement litigation on behalf of a nationwide company, I can also advise and represent clients in much simpler matters. Many companies do not realize that they may have valuable rights, even if they never registered with the U.S. Patent & Trademark Office. I specialize in analyzing whether they have secured rights under federal, state or common-law.and under related areas of law, such as "unfair competition" law and/or RICO.

  3. Employment and labor
    I have negotiated collective bargaining agreements, and handled grievances and arbitrations and major litigation in 4 sectors: the private (NLRA), public (state, county & municipal), railway labor sector (railway and airline), and federal sectors. I take particular pride in having served as general counsel to the New York City Civil Service Technical Guild over the course of three different union administrations. CSTG represented 7,500 professionals in the employ of the City of New York.

    Although the bulk of my IP practice concerns copyright and trademark issues, I have also been called upon to advise clients in other IP-related areas: patent infringement, trade secrets, unfair competition, RICO, false advertising, issues related to privacy and/or publicity rights, merchandising, fashion & design protection issues, etc.

    I have handled a considerable number of arbitrations over the years and have recently completed training to become an arbitrator. Being in a class action lawsuit, her response to calls, trust, concerns, and information went beyond what I have experienced in the past from lawyers I have had to deal with on a personal basis.

A great lawyer!
Emily is the attorney for our class action lawsuit and she has done a marvelous job of keeping us informed while providing the best top-notch representation that is above the average lawyer. She is knowledgeable and resourceful and keeps on with the job from start to finish with the same professional demeanor that was present at the beginning.

Intelligent, Conscientious & Unrelenting ... Legal Advice at its Very Best!
There are three types of attorneys out there: those who do nothing, those who do something, and those who fight tooth and nail for their client. Emily Bass is definitely the latter. She takes on giants in defense of her client and does so with no fear whatsoever. She goes into battle with only one sidearm–knowledge of the law. This might sound like an effort to build an attorney of mythical proportions but it is not. I am simply describing as best I can the attorney who’s fought for me for six long years. She took my case when others wouldn’t consider it. She took my case knowing that it would be exhausting both financially and physically. Remarkably astute and reassuring!
I first heard of Emily Bass through the National Writer Union's descriptions of her stalwart work in the landmark Tasini v. NY Times Co. case, in which she successfully defined and defended the copyrights of freelance writers when publishers try to include their previously print-published articles in electronic databases without obtaining permission or offering payment. At about the same time, I and several fellow authors and literary estates were encountering problems due to what was eventually ruled in Seoul, S. Korea to be copyright infringement by the publishing company Kaya (NY, NY, but owned at the time by a Korean publisher). Emily and her assistant offered prompt and crucial advice and assistence that made it possible for our group to reach important out-of-court settlements in our favor. More recently, I again retained Emily--now working independently in her own practice--for advice and research on another copyright issue. As fully expected, Emily did rigorous research in a very difficult legal area that allowed us confidently to reach a set of conclusions that are guiding my choice of action. It is important to note that, in addition to (or, perhaps, underpinning) Emily's brilliance, determination, and idealism as an attorney, her compassion and quick ability to understand wronged individuals' concerns and complex predicaments are invaluable to their sustaining the process of seeking justice. Ms. Bass is intelligent and articulate but knows how to tailor her communication to her audience. Her work ethic is extraordinary as is her conscientiousness. Simultaneously she is able to assess and remain focused on the bottom line to the ultimate benefit of the client.
