EducationIn 2002, after high school, I received an Air Force ROTC Scholarship to attend college. I graduated from the University of San Diego in 2006, and commissioned into the Air Force immediately. Instead of going straight onto active duty, I was selected for a competitive program through the Air Force JAG Corps that allowed me to attend law school before serving my active duty time.
I attended law school at Chapman University School of Law. From the very beginning, I loved everything about law school – the theory, the case studies, and especially the legal writing. In law school, I received eleven awards for getting the top grade in a class. I was also picked to be an editor of the law school’s most prestigious law journal. I also worked for a federal appeals judge. Every year, I was ranked #1 in my class, and in 2009, I graduated summa cum laude as the valedictorian of my class.
Court-Martial Lawyer
After law school, I came directly onto active duty as an Air Force JAG. During my first assignment at Dover Air Force Base in Delaware, I was identified by my boss as the best litigator in the office, despite being the most junior attorney. As a result, I was given the chance to prosecute all the high profile cases that came through, including sexual assault, larceny, and drug offenses. Given the rare honor of being ranked #1 as the junior Captain in my office was only the beginning. Throughout the rest of my career, my bosses recognized my abilities as a stellar legal advocate and legal writer. While many junior JAGs were busy prosecuting petty crimes, my skill allowed me to lead the prosecution of some of the Air Force’s most serious sexual assault cases. In 2011, I was selected to be the Area Defense Counsel for Dover Air Force Base.
In 2012, I began my final assignment at Vandenberg Air Force Base in California as a prosecutor. This same year, my husband began Cherkasky Law. I knew the minute the firm opened that this was the way I was going to help America’s heroes.
While I was awaiting my opportunity to punch from the Air Force, I was selected to be the Air Force’s first Special Victims’ Counsel to represent alleged victims of sexual assault. In this position, I learned exactly the extent to which the military will go to destroy a person accused of sexual assault and protect at all costs the accusers, no matter how weak or obnoxious the facts of the case.
I bring to the table what no other member of the civilian defense community offers. As a female, I understand personal responsibility. I understand what happens at the bar at 2:00 in the morning. I understand the incentive to fabricate a lie. When you’re deciding who you want to represent you, these things matter.
No matter what type of case or action you’re facing — administrative action or court-martial — I bring my passion to the fight. I’m always there for my clients, and will talk and work through every possible legal angle that exists to make sure we’re doing everything we can to salvage your career, your reputation, and your right to justice. It is terrible when even a single client is not completely satisfied with our services. Unfortunately, the author of this review is not identified to us and we have not received any similar complaints from our clients. We would be happy to discuss the feelings of this reviewer and make sure we do whatever we can, within the bounds of the law and our ethical responsibilities, to ensure they are satisfied. There are many reasons why even the most ferocious criminal attorney may not satisfy a client. Often, as is the case here, the outcome rather than the effort is the criticism. When the evidence is overwhelming of guilt, often the best we can do is mitigate the damage. Some clients want their attorney to interfere with an investigation, intimidate witnesses, or hide evidence. All of this amounts to criminal obstruction of justice. In other cases, we may advise our clients to fight hard at a court-martial, but they decide not to take our advice and decide to leave it in the hands of their commanders in administrative functions which are historically unfair, and then later complain about the outcome of those administrative actions even though they were well advised when they made the decision in the first place. Narrowing down the possible clients this review could have been written by, we are left to conclude that this client is one that was unwilling to risk the negative consequences of a court-martial because of their admitted guilt, but failure to accept that their criminal conduct would result in at least some negative consequences for violating the law. This client fails to recognize that the avoidance of significant confinement and negative discharge from the service was a fantastic victory given their decision not to demand trial by court-martial. Sexual assault cases may be the majority of cases we defend at trial, but we defend cases that span the spectrum of UCMJ allegations, from murder, to minor administrative discipline matters. We fight zealously for every client we elect to take on. The way we approach our cases is based on dozens of years of experience, involvement in thousands of administrative matters, and hundreds of fully litigated jury trials. We always strive to meet the desires of our clients, but there are times that a client’s lack of legal training and experience leads to unrealistic expectations of what a defense attorney can accomplish. Prior to this review, we recently published blog articles on our website about what makes a successful attorney. As those articles explain, a case that ends favorably is not a victory unless it ends exactly as the client wanted it to end – even if those desires were unreasonable or impossible. We strive to meet the desires of our clients, no matter how difficult their case is or how slim their chances of victory may be; however, after years of such high-risk legal practice, there are bound to be clients that are not entirely satisfied with the results of their case. Again, we desperately want to make sure our clients feel that we did everything we could and understand why we may be limited by the law and ethical responsibilities in certain regards. If the author of this post would like to discuss further, we are more than happy to take the time to address and hopefully take action to satisfy this individual client of the thousands we have had over the years.
