As a recent client, I express my sincere appreciation for Gregg Wisotsky’s representation. My case was rather complex in that I was involved in an automobile accident and based on honest responses, the police had filed for: a warrant to draw my blood while in the hospital ER and a ‘Dyal subpoena’... to obtain my hospital records; both in order to determine my blood alcohol concentration (BAC). After having extensively reviewed the Internet for blood alcohol cases, I quickly understood should either test come back with a positive result the chances of being prosecuted to the extent of the law, which is rather rigid and non-negotiable, are almost 100% in favor of the State. Having never appeared in court for any reason, I was totally naïve about the aggressiveness and the extent the state would go to in gathering evidence and prosecution of an individual based on suspicion. In my opinion, right or wrong, I felt as if the local police and the prosecutor primarily were primarily concerned in determining if there was enough evidence to convict of a targeted activity (DUI arrest and prosecution), and did not consider it their responsibility to research the validity of the evidence to determine potential innocence prior to prosecution. After this experience I’m a little less naive. It quickly became apparent to me that if I hoped to win a case or minimize my sentencing, I would need someone who understood the laws regarding drawn blood BAC and someone whose professional opinion I could respect should he tell me ‘let’s lose gracefully’ if need be. What I am familiar with is how to find capable resources. After doing my research online about applicable law and cases that had positive and negative outcomes, etc…. I interviewed several attorneys and was not satisfied. I received responses, which lead me to believe they were out of touch with current laws, did not understand the legal vehicles available to the prosecutor and the rigidity of the laws surrounding BAC. I had lawyers telling me I should plead guilty and rely on the leniency of the judge before they reviewed all the facts. I came upon Gregg Wisotsky’s name through Avvo and after having received the response back from the police that I was being charged, sat down with Gregg in his office to discuss the facts regarding my case. The final result of Gregg’s representation was the dismissal of the charges against me. Had I not had Gregg’s expert representation, I am sure the outcome of my case would have been very different. Don’t assume that just because there is evidence against you, that you can’t dispute its voracity. Don’t assume that if an attorney says he’s represented clients in DUI cases that he’s competent.
