Immigration worksite enforcement by federal authorities has ramped up to unprecedented levels and shows no signs of abating. Employer’s must therefore focus on Form I-9 compliance. The substantial increase in the number of I-9 audits and related arrests by U.S. Immigration and Custom’s Enforcement (ICE), coupled with the doubling of civil penalties, makes this a looming threat to small businesses and larger corporations alike. ICE has a stated goal of doubling the number of Notices of Inspection (NOI) served on employers from 2,281 year to date to 5,000 by September 30, 2018. Employer arrests (through the I-9 audit process) are up 91% year-over-year and administrative (alien) arrests are up 255% over the same period.
