It is true that this client's case was highly unusual, in that his situation fell exactly within the parameters of the French Decree of September 6, 2011, which transposes the European Directive from 2004 which the French administration should have been applying in regard to same sex partners in marital relationships in the EU. The result in this case establishes the fact that the administration is finally complying with European directives. Unfortunately, as regards the non-EU partners of French citizens, the administration continues to apply internal law and is thus discriminating against the partners of French citizens! This is not the first time that the French administration has favored EU member citizens over its own citizens, creating a discrepancy in treatment! In fact, recent circulars have acknowledged this discrepancy and have specifically stated that a French citizen may not claim the quality of a European citizen in order to benefit from the more favorable provisions.

It is indeed possible to request a right to travel from the French OFII (immigration) office or Préfecture while waiting for a carte de séjour.

successfull immigration of Russian family to France
