Attorney Robert D. Moriarty joined the law firm of McCarron, Murphy & Vukota, LLP in June 2011 after more than four years in the Office of the District Attorney for the Cape & Islands District.  Attorney Moriarty specializes in criminal defense, civil litigation and real estate law.


During his time in the District Attorney's Office Attorney Moriarty prosecuted cases in both the District and Superior Court.  Attorney Moriarty's trial experience ranges from misdemeanors such as Operating Under the Influence of Alcohol, Assault and Battery and narcotic distribution to the more serious felonies of Motor Vehicle Homicide, Indecent Assault and Battery, and Breaking and Entering.



In March 2009, Attorney Moriarty was assigned to the Appellate Unit in the DA's Office. In that capacity, Attorney Moriarty represented the Commonwealth in twenty-five cases before the Appeals Court, two cases before the Supreme Judicial Court, and fifteen cases in the Single Justice session of the Supreme Judicial Court. During this time, Attorney Moriarty also handled the opposition to numerous motions for new trial in both the Superior Court and the District Court, while supervising the Nantucket District Court and prosecuting several other serious vehicular homicide cases at the trial level in both the Superior and District Courts.  Attorney Moriarty also presented the "case law update" at many police trainings that were run by the Cape & Island D.A.'s Office.



Since joining McCarron, Murphy & Vukota LLP in July 2011, Attorney Moriarty has successfully defended clients charged with a variety of criminal matters from major felonies in Superior Court to motor vehicle violations in the District Court. The crimes he has won acquittals on after trial range from attempted murder to operating under the influence of liquor. As a defense attorney, he has argued before the Supreme Judicial Court and the Appeals Court.  In March 2014, Attorney Moriarty was appointed as the Supervising Attorney for the Bar Advocate program that serves Dukes and Nantucket Counties by the Committee for Public Counsel Services. In that capacity, he supervises several other criminal defense attorneys on Martha's Vineyard and Nantucket who ensure that zealous, competent and thorough advocacy is available to everyone charged with a criminal offense regardless of their economic position.  As a skilled trial attorney with a proven track record for success, Attorney Moriarty has the ability to evaluate the facts of your case and advise on the best course of action for each specific case.  His history as a prosecutor together with his experience as a criminal defense attorney has proved invaluable in getting his clients the best results possible. Attorney Moriarty Goes the Extra Mile
Attorney Robert Moriarty is a man of integrity, commitment and decisive action. Two years ago when I was arrested for a third OUI I hired him because he was a highly recommended by a Vineyard resident who knew of his admiral reputation as an OUI attorney.. We met and I immediately felt a sense of mutual respect. He listened attentively to my description of the incident where my license was suspended because of an alleged refusal of the chemical breath test. Using his knowledge of the OUI laws and RMV policies he scheduled an appeal at the RMV. When that appeal was denied, he did extensive research to collect the necessary data to write a detailed brief to contest the chemical test refusal in an appeal before the judge in the Edgartown District Court. My license was reinstated by the RMV as a result of that judge's ruling based on Attorney Moriarty's brief and my case was dismissed soon after that. Throughout the whole process I trusted Attorney Moriarty to be vigilant about developments in my case and to advocate on my behalf. I highly recommend him as an experienced attorney who goes the extra mile.

Got serious charge reduced as to not be a sex offender
He always answered my calls, while on the street and in jail. He visited me in jail often and kept me updated frequently on his discussions with the district attorney. He filed several motions that were granted and kept me updated on that as well. He looked at all evidence and was able to get the DA to agree to reduce my charge. I was charged with a serious offense, indecent assault battery on a child under 14 and he was able to get it reduced to a simple assault battery as to make me a non sex offender. He works very hard with all his clients and works very well in the courtroom. I like that he can express his concerns with the evidence and get the best possible outcome for his clients through the DA and Judge. He's very persuasive, persistent, and determined to get his clients off of charges. By far the best attorney that I've ever had and I've had many. He is not prejudiced against a person and their crimes, just works with what the evidence is and what he thinks he will be able to get dismissed. He gives good advice regarding going to trial or to take a deal and leaves it up to the client to decide. He gives his input on whether he thinks trial is or isn't the best option and whether a plea deal is best, but he leaves it up to the client to make the decision. I highly recommend him.

DUI Attorney
After a DUI arrest and waiting in court nervous and unsure, I spotted Robb working with his clients in similar situations. I observed he was down to earth and fully present for his clients at the same time showing professionalism as he represented them in the proceedings. I asked for his card and had a small discussion. He offered to stand for us in the initial proceedings to help us navigate the legal system. We hired Robb and couldn't have been more satisfied with the work and representation he provided. Robb made himself available to us on weekends and evenings as our schedules allowed. He is down to earth, easy to talk with and works tirelessly on his clients behalf. Honest, Truthful, & Real: A Great Lawyer
Mr. Moriarty was referred to my by a friend and client of his who had a successful outcome in her case. Needing legal assistance I consulted with Mr. Moriarty about my case, gave all the documents necessary and explained why I was in trouble. He took time off on a Saturday to meet with me to fit my schedule for the initial consultation. From the get go he was real and honest. He did not fill my head with empty expectations, when it came to being ethical and explaining all possible scenarios and outcomes, he was covered and I was fully informed. Hired immediately. He is excellent at communication; phone calls and emails were made to keep me in the loop of what was going on only when it was necessary. On the day of the arraignment and follow-up appearances, he took the time to sit with me to talk about what was going to happen that day, what I could expect, and what our next plan would be if things went our way, and a back-up "just in case". After about ten months (the speed of light our legal system), we were very successful in our case. Not only is Mr. Moriarty a great lawyer, he is an understanding man. I have known others who have used Mr. Moriarty in the past, all whom are fond of his legal representation using words like "fantastic, real, grounded", and his colleagues who use words like "he's a really really good guy." Attorney Robb Moriarty - Smart, Kind and Just

I contacted Robert Moriarty after I was convicted of O.U.I. After conferring with Robb regarding the possibility of an appeal, he felt that there was enough evidence to move forward. Through Robb's case research and exceptionally sharp eye to detail, he was successful in getting my case re-tried. At the trial Robb was calm and confident, easily picking apart the prosecutions case and I was acquitted of the O.U.I. charge. Robb is a thorough and competent professional who always answered my calls or texts and never left me with any questions. I'll give Robert Moriarty five stars although he certainly is deserves more.

Great lawyer
Rob was great, was open to meeting with me and listened to my case. He was able to work around my busy schedule and even won my case for me. Rob also was able to appear in court on days I had to be absent. I would recommend him to anyone in need of a lawyer.
