Description: Thomson sold a home to buyer. Buyer discovered defects with the home after the purchase closed. Buyer sued Thomson claiming that Thomson failed to disclose known defects. Thomson turn the matter over to their insurance carrier, Allstate. Allstate subsequently sued Thomson alleging that Allstate had no obligation to defend or indemnify Thomson. Allstate twice brought summary judgment motions against Thomson. Twice, we defeated those motions. Ultimately, Allstate agreed to pay Thomson's entire defense of the Buyer's action.
