Case Conclusion Date: October 31, 2006
Practice Area: Estate Planning
Outcome: PreMarital Will held to be valid
Description: The deceased made a Will while dating the claimant. In the Will, the deceased made a sizable cash gift to the claimant. However, the deceased left the remainder of the Estate to her brothers and sisters. The remainder of the Estate exceeded the monetary gift to the Plaintiff. A few years later, the deceased and the claimant were married. Less than 30 days after the parties were married, the deceased died. The claimant alleged the Will was invalid and made a claim to the Estate which exceeded the gift identifed in the Will. I represented the Estate along with another law firm and the Pre-marital Will was held to be valid.
