Description:Jason Moore was hit from behind while riding his bicycle early one morning. He had extensive orthopedic injuries. Jason was riding in the roadway, as the shoulder was too soft to ride. The uninsured driver rounded a bend, and struck Jason at approximately 35 miles per hour. We hired a visibility expert to show what, exactly, the approaching driver should have seen had he been looking. The arbitrator awarded $340,000, but assigned 30% comparative negligence to Jason. Thus, the net award was $238,000. Jason deserved every penny of it.
