Description: Two pounds of methamphetamine and other drugs, as well as evidence of drug dealing, were found by police in plain view in the defendant's apartment during a parole search of his mother, who shared the residence. Although the drugs and other evidence of drug dealing were in plain view in the apartment, and the defendant was charged with possessing them in a joint criminal enterprise with his mother, I was able to persuade the court during his preliminary hearing that the evidence of constructive possession or aiding and abetting was insufficient to meet even the low evidentiary threshold of a preliminary hearing, and all charges against him were dismissed.
