Description:Plaintiff, a 34 year old male commercial truck driver, suffered a slip and fall accident in convenience store, fracturing his patella (knee cap). Convenience store had had chronic problems with condensation forming on air conditioning duct, occasionally causing water to drip onto tile floor of store. Although plaintiff had previously injured same knee, he was able to continue employment as truck driver until the accident in convenience store. Plaintiff retired from truck driving at recommendation of his primary care physician and incurred approximately $20,000 in lost wages per year.
