Vosilla v. Rosado

Case Conclusion Date: 11.09.2006

Practice Area: Real Estate

Outcome: My client got their house back

Description: My clients were property owners who lost their house in a tax deed sale. They had given the taxing authorities a change of address. However, they never received notice of the tax deed sale because the clerk of court failed to send notice of the sale to their new address. The Fifth District Court of Appeal in Florida reversed its prior position and found that failure to give my clients notice at their new address violated their federally protected due process rights. On further appeal, the Florida Supreme Court agreed and rule in favor of my clients, allowing them to keep their house. Vosilla v. Rosado, 944 So.2d 289 (Fla. 2006), SC-05-1778, November 9, 2006
