Description: A case of first impression in Georgia involving whether an arbitration clause could be enforced to deny the family of a deceased nursing home resident their day in court before a jury. Mr. Nohr successfully defeated the nursing home’s efforts to force the case to arbitration, thereby helping to preserve the right to a jury trial for all Georgia nursing home residents and their family members. See Ashburn Health Care Center Inc. v. Poole, 286 Ga. App. 24, 648 S.E.2d 430 (2007).
