Description: Ms. Fiadjoe, a citizen of Ghana, petitioned for review of the denial of her application for asylum, withholding of removal and relief under the Convention Against Torture (CAT), as well as of the denial of her motion for reconsideration. The Court of Appeals, held that substantial evidence did not support Immigration Judge's (IJ) credibility determination, nor that of the Board of Immigration Appeals (BIA). In particular, the Third Circuit harshly criticized the Immigration Judge for his insensitive questioning of Ms. Fiadjoe, a victim of post-traumatic stress disorder. Ms. Fiadjoe and her daughter were allowed to re-enter the United States from Canada, where they had fled to while awaiting a decision, and re-unite with her husband.
