State v. Lenarz

Peter Gilbert Billings

Case Conclusion Date:July 19, 2011

Practice Area:Criminal Defense

Outcome:Conviction Reveresed and Charge Dismissed

Description:Clients conviction was appealed to the Connecticut Appellate Court on two grounds both of which had been raised with the trial court. The main issue involved the attorney client privilege as provided by the Sixth Amendment to the United States Constitution. In July of 2011, the Connecticut Supreme Court released its decision – a complete dismissal of the sole conviction. The Court held that “the taint caused by the state’s intrusion into the [attorney client] privileged communications would be irremediable on retrial and the charge of which the defendant was convicted must be dismissed.”
