I agree with the previous answers, no one on this site can give a detailed answer based on so few facts. He needs to speak to his lawyer to address specifics.
This answer is being given for general informational purposes only and is not protected by the attorney-client privilege since this is a public forum. The information provided does not create an attorney-client relationship. No communications with me on this forum shall be construed as arising out of an attorney-client relationship. If a client needs specific legal advice or opinions, he or she should retain counsel for advice or to undertake representation.
The statements of witnesses is evidence. So there is "some evidence." Whether it is enough to sustain a conviction is a question for his lawyer who has all the info that we don't.
DO NOT EMAIL OR CALL WITH FOLLOW UP QUESTIONS. I will not respond. This post is for information purposes only and does not constitute legal advice, nor does it establish an attorney client relationship with Mr. Cassara.
No offense but if there is no evidence then there can be no charge (otherwise stated: there is evidence even if you are either unaware of or chose not to recognize it as such). That said and for a specific answer to your question you should ask your loved one’s lawyer (who will be provided with the evidence by the government). Wishing your loved one luck and hoping that my response has been helpful.
First, second and third: No attorney-client relationship exists by virtue of any Q&A with Michael A. Haber, Esq. on Avvo. Fourth: Anything that you post on Avvo (or on similar sites) or on any social media is by its nature public. It is essentially an admission / confession and can be introduced into evidence as a statement against your interest in a subsequent legal proceeding. Once posted you lose any reasonable expectation of privacy, so, as this is an open forum (with no privilege attached), please be extra careful when considering what to post online (forewarned is forearmed.)
