Can I report a vehicle stolen if it's not technically mine?

My father passed away a few months ago and we are still going through probate, question about that litigious nightmare soon to come. So my younger brothers truck broke down and he decided to use my dad's truck to get to work. My dad's truck was paid off with only 35k miles on it,mint condition. However due to him being deceased for many months now and the current probate battle with another sibling the trucks insurance had lapsed.

My brother now tells me that the truck was stolen and that the police won't let him file a report despite the fact that my dad has passed away and he's an heir. Is this legitimate? Because I have serious doubts and concerns.

You as personal representative MIGHT be able to report the truck stolen, but even you might have issues with the local police or sheriff. They can be kind of a pain. I had a client who had a very difficult time with the same issue and it took quite an effort for her to get the police to take her report for the stolen car since she was not the title holder. An heir who does not represent the estate is likely not going to be able to file the report, although his information is going to be needed if he was the last driver.
