Can I drink still if I haven't been to court yet for a DUI I went to my arraignment and my court date is October 5th?
I have not been to Court yet for my DUI I did have an arraignment can I still drink if I obviously don't drive and obey the laws? And I am not on probation yet.
The only thing that might prevent you from drinking is your bond conditions. But every time a client asks this question I worry because the next thing I hear is how they didn't mean to drive while drinking but an emergency came up or they were tired and not thinking right or any number of other excuses and they got rearrested. Or they got in a fight with a wife/girlfriend and got arrested for public intoxication and domestic assault or some other arrest. But speak to your lawyer to be sure there are no bond conditions that require that you avoid alcohol or drugs.
Nothing in this communication should be construed as creating an attorney-client relationship. I provide this service for educational purposes only. I will take no action on your behalf unless you have hired me and a written retainer agreement is signed. I am licensed only in Tennessee and I strongly suggest you consult with an attorney in your city and state as Statute of Limitation deadlines can limit your recovery.
When people ask this kind of question is makes you wonder if they do not have a drinking problem. If you are so concerned about not being able to drink (and I assume you mean alcohol) then you need a different kind of help.
As to your question, there is nothing that prevents you from drinking based upon your question. However, there may be other matters that restrict your ability to drink that are not revealed, such as a medical determination, or a previous criminal or civil order that prohibits the consumption of alcohol, either all the time or during certain times. (A somewhat normal provision in a visitation issue which prohibits the visiting parent from consuming any form or alcohol within x number of hours before the visit, for example).
