Question

I was charged with a DUi less safe and failure to maintain lane, in Hall County. I was 100% sober

I was charged with a DUi less safe and failure to maintain lane, in Hall County. I was 100% sober (a bit tired).

I took and obviously passed the breathalyzer and feel like I did fine on the field sobriety test. I refused the blood test. I made the decision ti refuse because 9yrs ago (before I quit drinking), I got reckless driving and didn't blow or give blood test. However, that was in Fulton County. I did not realize that a refusal would result in an automatic license suspension for a year.

I hired an attorney and he filed an appeal. Now I am being told that if the video evidence will not be released until after the Admenistrative Court date (on Dec 10th) and if I do not plead guilty, the police officer will definitely not negotiate regarding the suspension of my license. I can't afford to lose my license, as I drive for a living! But, it doesn't feel right admitting to something that I know I didn't do.

It doesn't feel fair that we don't get to see the video evidence before the Admenistrative court date.

Since you’ve already hired an attorney, these are issues that you need to discuss with them. If you don’t trust your legal representation, then you may need to hire a different attorney with whom you can address your concerns.

You should talk to your attorney about these issues. There are plenty of ways to continue the Administrative Hearing especially if there is evidence missing. There are also ways to avoid the 12 months suspension that do not involve admitting to the underlying DUI charge. Bring these questions to your attorney and make sure you know all your options before deciding anything.
