Are lie detector tests admissible in court?
I am being accused of a break in simply because of my background. I AM INNOCENT. They claim to have blood evidence and they know who done it, but are still pestering me constantly and asked me to submit to a polygraph test. I agreed because I have nothing to hide. If I fail, simply due to nerves (who wouldn't be scared in this situation)...can they use the results against me as evidence in court?
Lie Detector Tests (polygraphs) are not admissible in a Court of Law. They lack the requisite reliability to be admitted in evidence. It would be best not to take the test, especially if you feel bullied into it. Any mention of you taking/not taking the test would also be inadmissible, unless you open the door by stating you were fully cooperative with the police. The district attorney then can state that you were in fact not fully cooperative because you refused to take a lie detector test. Regardless, the result is inadmissible and the following exchange would only take place if you actually testified in court.
Actual NC lawyer answering- no, the results are not admissible in court. You are being bullied and intimidated either by law enforcement or some member of the public. Don't take the test- it's likely somebody will lie and say you flunked just to get you to say something which will hurt you. Please speak with a lawyer- you need somebody to have your back and protect you.
