Hi, I wanted to know could you tell me if a person has already been sentenced and they have a motion put in for a vacated senten
OK, I wanna know if my son has taken a plea deal for seven years and he’s already serving the seven years if he go back to court on a vacated sentence or a sentence reduction can the judge impose a higher sentence than the seven years he’s already serving

I'm not entirely sure that I understand your question. I believe you are asking whether your son's request for a sentence reduction could actually result in a higher sentence. If that is your question, the answer is no. He is not risking an increased sentence by asking for a sentence reduction. He will either get a reduction or he won't. But he can't get an increase.
