Alexander Jared Sperber

I have been involved in a wide range of litigation at both the trial and appellate level, representing clients in federal and state courts.  My practice focuses on commercial, general liability, title, and life insurance.    

Recent Engagements: 

•Successfully represented institutional investor in a multi-million dollar federal court litigation challenging insurance rate increases affecting hundreds of universal life insurance policies, resulting in a settlement valued at over $60 million.

•Won appeal to the Second Circuit Court of Appeals, wherein the appellate court held that a series of collisions with a single obstacle, each separated by only 30 seconds, constituted three separate policy occurrences, despite policy language purporting to aggregate all damages "resulting from continuous or repeated exposure to substantially the same conditions."  

•Successfully argued for temporary restraining order, barring insurance company from demanding payment of allegedly past-due insurance premiums pending decision on order to show cause.

•Won summary judgment dismissing insurance subrogation action, where the court held that the plaintiff-insurer's action against the defendant-insurer was barred by the doctrine of circuity of action; this appears to be the first case directly applying the "circuity of action" defense in the Second Circuit since a decision by Judge Learned Hand in the 1950s.

•Successfully litigated action to confirm arbitration award wherein judge initially held action barred by statute of limitations, but reversed himself on motion to reargue and renew.

•Won appeal to the Second Circuit Court of Appeals, wherein the court upheld dismissal of a multi-million dollar lawsuit alleging multiple counts of fraud and breach of fiduciary duty against trustee of life insurance trust.

I am also an active member of the New York City Bar Association's Committee on State Courts of Superior Jurisdiction.
