Matthew Pek is an associate in Guzov Ofsink’s litigation, arbitration, and mediation group. While his primary practice centers on complex commercial litigation, Matthew has represented clients in a variety of general litigation matters ranging from estate proceedings to intellectual property and free speech litigation. Matthew has successfully appeared in both state and federal court on a diversity of litigation matters, in which his victories include a federal trademark and domain name infringement prosecution in the Eastern District of New York, securing the deletion of infringing websites within twenty-four hours of demanding such emergency injunctive relief; defending Manhattan condominium owners against a mechanic’s lien action, securing their dismissal based on an issue of fi rst impression; and an emergency application to Supreme Court, Commercial Division to freeze shares of stock held by a transfer agent in a successful effort to thwart suspected fraudulent activity. Matthew has second-chaired a federal trial in the U.S. District Court in Connecticut and has assisted in defending a preliminary injunction action before the Southern District of New York. Matthew has demonstrated his ability to fi nish what he starts, successfully executing upon multiple judgments within the State of New York. A relentless advocate, Matthew is an active pro bono practitioner in addition to his private practice.

Following two successful years at Guzov Ofsink, however, frustrated with the growing volume of recession-driven litigation, and compelled by an intrinsic desire to devote his time to more altruistic endeavors, and in spite of the increasingly unstable job market and continuing economic downturn, Pek took a giant leap of faith in November 2009, left his Madison Avenue law firm and plunged into the highly competitive NYC food industry - unchartered territory in which he had no experience - and founded his own organic hot cocoa and fair trade foods company, Organicoa, LLC, where he continues to serve as CEO, General Counsel and Brand Ambassador. With virtually no start-up capital or formal business model in place, partnering up with his lifelong friend and real estate developer, Brett Nidel, Pek launched the company and entered the organic foods industry by winning a highly coveted Temporary Use Permit from the NYC Parks Dept., permitting Organicoa a mere 29 days to operate a cocoa stand atop the recently refurbished and highly popular High Line. Parlaying his trademark and branding experience, and centering the entire company's around a single yet powerful notion - "sustainability first", determined to lead by example, Pek developed a sustainable business model that placed environmental stewardship before profits at every turn, aspiring to demonstrate that "commerce and ecological conservation are by no means mutually exclusive in a capitalist society." Unwavering in its commitment to sustainable business practices, Organicoa's rapid growth, expansion and rising popularity drew immediate press attention and accolades, including an award for "Top 10 Best New Brands for Culinary Genius" in 2009, a 5-year lease for a waterfront cafe on Pier 45 in the Hudson River Park, and a permanent home in Chelsea, where Organicoa's newest location is set to open this summer. Nevertheless, a self-described "born litigator", Pek continues an active law practice as a solo practitioner, having founded his own law firm (The Law Offices of Matthew A. Pek, Esq.) in 2010.
