Traffic tickets resulting from a motor vehicle accidents are usually resolved with a complete dismissal of the violation providing there are no aggravating circumstances. A dismissal of the case results in no points being assessed against either the DMV record or the insurance. However, the insurance company may assess you points as the result of the driver of the other vehicle making a claim against your insurance policy. This depends on the specific terms of your policy. This is a separate issue from the traffic violation that in this case was dismissed completely in court. Unfortunately, this is a common misunderstanding in cases of this nature. We do try to inform our clients of this possibility during our consultations and we are always available to answer any questions afterwards.
