James, As we’ve discussed offline on numerous occasions, you are simply mischaracterizing our discussions and understandings. When you retained me two days before your hearing, I requested a 6-hour retainer deposit based on my estimate of two hours for the hearing itself and four hours to undertake a number of pre-hearing tasks, including the following items: consultation with you, review of the trial transcript, the pleading history, and the discovery requests and responses previously exchanged by the parties, and drafting and filing a written response to the pending motion for new trial. Contrary to your contention, I ordered the trial transcript by email minutes after speaking with you on the phone, but the court reporter was unable to provide the transcript in time since it was ordered less than two days before your hearing. I completed the remaining items outlined above in approximately three hours. Almost immediately after we won your hearing, you began to state that I was overbilling you, even though I estimated 6 hours for the representation and finished it in 4.4. I attempted to resolve the matter with you over the phone, but you insisted upon an alternative set of facts and would not accept any compromise other than your suggestion that I bill you for 2-3 hours only. I certainly never hung up on you. In an attempt to assuage your concerns – which you were very passionate about – I wrote you a 4-page letter detailing the time expended, to the minute, with reference to call history, emails, timestamps on filings, and the record of time entries in my practice management software. I even discounted your bill by $125 in an effort to stop you from following through with your threats to damage my reputation with online reviews. Clearly, that effort failed. However, I stand by everything in my letter and reiterate that you were not overbilled; you were actually billed substantially less than earned. I regret that my efforts to end our business on a positive note were unsuccessful and wish you the best in your future engagements. Sincerely, Jacob W. Stasny
