The issue that it is your uncle is for you to decide. However, if you are working OT and not compensated for such, you are entitled to hour worked...

You should make a claim with New York State Department of Labor, Division of Labor Standards, for unpaid wages.

Make a claim for unpaid wages with the state wage and hour board. You are entitled to salary that you worked for.

They would still have to bring proofs regarding your misconduct. Be prepared with your medical evidence to the contrary.
