Horrible Trustee

David Gardner was the trustee on my Chapter 7 Bankruptcy. He failed to check out my creditors. He did NOT sell my home for the price listed on the Purchase and Sale Agreement wherein he sold it $25,000.00 under the purchase price as recorded on the Real Estate Purchase & Sale Contract. He overpaid... the Mortgage Company after I repeatedly informed him that the pay-off amount was $20,000 plus over what I actually owed! David's mission to sell my home gave him a huge pay-off! You need to keep an eye on him if you are assigned him as a trustee. And if you do have assets consult with a QUALIFIED HONEST ATTORNEY!

Ethical Failure

Hired David to handle a variety of matters for my business. He concealed a known conflict from us, taking on an important arbitration. When we discovered the conflict, he had to withdraw three weeks before the final hearing. David’s ethical failure hurt us and our interests. We had to hire a new firm... and pay additional expenses to get them prepared. I would not trust David with any matter of significance.

David took my case pro bono through the volunteer lawyer program. It could have been a simple bankruptcy case, but David took it all the way. He saw my student loan debt and realized that as a single working parent with medical problems that the loans would keep me in debt for my whole life and nega...tively impact my ability to ever get ahead. He poured hours of free time into my case in Booth vs. the United States. When he was so close to complete victory, he asked me to make the call on accepting a generous settlement offer. He said he was almost sure he could get all debt discharged but no one could say for sure. I took the settlement offer of 15,000 from an amount originally over 100,000. Dave won the volunteer lawyer of the year award from the Spokane bar association. I was there for the presentation of the award. After accepting the award, he handed it to me. Even after the settlement, he still fielded paperwork and phone calls on my behalf. All of this he did for free. I will never forget this honorable man he went many extra miles on my behalf and never received a dime. He was my angel and improved my life. This is a rare, rare event in the life of the poor. His moral character is beyond reproach. I will never forget him.
